本服務條款（下稱「本條款」）是你與上海活動曆創意服務有限公司（下稱「我們」）之間，就使用 Secalender iOS App、Apple Watch App、小工具及 secalender.com 網站（下稱「本服務」）所訂立的協議。請在使用前仔細閱讀。
下載、安裝、註冊或使用本服務，即表示你已閱讀、理解並同意受本條款及隱私權政策拘束。若你不同意，請勿使用本服務。
本服務提供行程管理、AI 行程規劃、活動分享、好友與群組協作、Apple Watch 與小工具提醒等功能。本服務持續迭代中，功能可能新增、調整或移除；我們不保證服務不中斷或完全無誤。
AI 規劃與交通時間僅供參考。行程建議由 AI 依你的輸入產生，交通時間為估算值。營業時間、票務、班次、價格與路況請於出發前自行確認；因依賴該等資訊所生的損失，我們於法律允許範圍內不負責任。
你對自己建立的行程、活動、文字、圖片等內容（下稱「使用者內容」）保有權利。為提供本服務，你授予我們一項全球性、非專屬、免授權費、可再授權的許可，於你設定的可見範圍內儲存、顯示、傳輸與備份該內容。你刪除內容或帳號後，該許可即終止，惟已分享給其他使用者或依法須保存者除外。
你聲明並保證你擁有使用者內容的必要權利，且內容不侵害他人權益或違反法律。
使用本服務時，你不得：
違反上述規範時，我們得移除內容、限制功能或終止帳號。
本服務整合第三方服務（例如 Apple、Google 登入、Google Maps、雲端與 AI 服務提供者）。使用該等服務須遵守其各自條款。我們對第三方內容、服務或其可用性不負責任。
本服務的軟體、介面設計、商標、圖像、主題內容與文件均屬我們或授權人所有，受相關法律保護。除本條款明示允許外，未經書面同意不得複製、修改、散布或用於商業目的。
本服務依「現狀」及「現有」基礎提供，不附帶任何明示或默示保證，包括適售性、特定目的適用性及不侵權。我們不保證本服務的正確性、完整性、即時性或不中斷。
在法律允許的最大範圍內，我們對因使用或無法使用本服務所生的任何間接、附帶、衍生、懲罰性損害或利潤損失不負責任，包括因不可抗力、第三方服務、你的裝置或網路問題所致者。我們對你的總責任，以你於請求前 12 個月內就本服務支付予我們的金額為上限；若未支付任何金額，則以美金 50 元為上限。
我們得隨時更新本條款，並於本頁標示更新日期；重大變更將另以 App 內通知告知。變更後繼續使用即視為同意。我們得在合理通知後暫停或終止全部或部分服務；你違反本條款時，我們得不經通知立即終止你的帳號。
本條款以中華人民共和國法律為準據法（不適用其法律衝突規則）。因本條款所生爭議，雙方應先友好協商；協商不成時，任一方得向我們註冊地有管轄權的法院提起訴訟。若你所在地法律賦予你不得排除的消費者權利，本條款不影響該等權利。
本條款任一條款無效時，不影響其餘條款效力。本條款與隱私權政策構成你與我們之間的完整協議。本條款以繁體中文版本為準，英文版本僅供參考。

These Terms of Service ("Terms") are an agreement between you and Shanghai Huodonli Creative Service Co., Ltd. ("we", "us") governing your use of the Secalender iOS app, Apple Watch app, widgets and the secalender.com website (the "Service"). Please read them before using the Service.
By downloading, installing, registering for or using the Service you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service provides schedule management, AI trip planning, event sharing, friend and group collaboration, and reminders on Apple Watch and widgets. The Service is under continuous development; features may be added, changed or removed, and we do not guarantee uninterrupted or error-free operation.
AI plans and travel times are for reference only. Itinerary suggestions are generated by AI from your input, and travel times are estimates. Please confirm opening hours, tickets, timetables, prices and traffic before you go. To the extent permitted by law, we are not liable for losses arising from reliance on such information.
You retain ownership of the schedules, events, text, images and other content you create ("User Content"). To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to store, display, transmit and back up that content within the visibility you set. The license ends when you delete the content or your account, except for content already shared with other users or that we must retain by law.
You represent that you hold the necessary rights to your User Content and that it does not infringe others' rights or violate any law.
When using the Service you must not:
If you violate these rules we may remove content, restrict features or terminate your account.
The Service integrates third-party services (for example Sign in with Apple, Google Sign-In, Google Maps, and cloud and AI providers). Your use of those services is subject to their own terms. We are not responsible for third-party content, services or their availability.
The software, interface design, trademarks, graphics, theme content and documentation of the Service belong to us or our licensors and are protected by law. Except as expressly permitted in these Terms, you may not copy, modify, distribute or commercially use them without our written consent.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service is accurate, complete, timely or uninterrupted.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential or punitive damages or lost profits arising from your use of or inability to use the Service, including those caused by force majeure, third-party services, or your device or network. Our total liability to you is limited to the amount you paid us for the Service in the 12 months before the claim, or USD 50 if you paid nothing.
We may update these Terms at any time and will change the date on this page; material changes will also be announced in the app. Continued use after a change means you accept the updated Terms. We may suspend or discontinue all or part of the Service with reasonable notice, and may terminate your account immediately if you breach these Terms.
These Terms are governed by the laws of the People's Republic of China, excluding its conflict-of-law rules. The parties will first try to resolve any dispute through good-faith negotiation; failing that, either party may bring the dispute before the competent court at our registered place of business. Nothing in these Terms affects consumer rights that cannot be excluded under the law of your place of residence.
If any provision is held invalid, the remaining provisions remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us. In case of conflict, the Traditional Chinese version prevails; this English version is provided for convenience.

你创建的行程、活动、文字、图片等内容（以下称「用户内容」）所有权归你。为运营本服务，你授予我们在你设定的可见范围内，存储、展示、传输与备份该内容的全球性、非独占、免权利金且可再授权的许可。你删除内容或账号后，该许可即终止，但已分享给其他用户的内容，以及法律要求我们保存的内容除外。
你保证对用户内容拥有必要权利，且该内容不侵害他人权利、不违反法律。
使用本服务时，你不得：
违反上述规定时，我们可移除内容、限制功能或终止你的账号。
本服务集成第三方服务（例如 Apple 登录、Google 登录、Google 地图，以及云与 AI 服务商）。你对这些服务的使用适用其自身条款。我们不对第三方内容、服务或其可用性负责。
本服务的软件、界面设计、商标、图形、主题内容与文档，归我们或我们的授权方所有，受法律保护。除本条款明确允许外，未经我们书面同意，不得复制、修改、分发或商业使用。
本服务按「现状」与「现有」提供，不提供任何明示或默示的保证，包括适销性、特定用途适用性与不侵权。我们不保证本服务准确、完整、及时或不中断。
在法律允许的最大范围内，对于因使用或无法使用本服务而产生的任何间接、附带、后果性或惩罚性损害及利润损失，包括因不可抗力、第三方服务或你的设备与网络所致者，我们不承担责任。我们对你的全部责任，以索赔前 12 个月内你就本服务向我们支付的金额为限；若未支付任何费用，则以 50 美元为限。
我们可随时更新本条款并修改本页日期；重大变更还会在 App 内公告。变更后继续使用，即表示你接受更新后的条款。我们可在合理通知后暂停或停止全部或部分服务；若你违反本条款，我们可立即终止你的账号。
本条款适用中华人民共和国法律，不含其冲突法规则。双方应先以诚信协商解决争议；协商不成的，任一方可向我们注册地有管辖权的法院提起诉讼。本条款不影响你居住地法律中不可排除的消费者权利。
若任一条款被认定无效，其余条款仍然有效。本条款与隐私政策构成你与我们之间的完整协议。各语言版本如有冲突，以繁体中文版本为准，其他版本仅为便利提供。

本サービスをダウンロード、インストール、登録または利用することで、本規約およびプライバシーポリシーを読み、理解し、これに拘束されることに同意したものとみなされます。同意いただけない場合は、本サービスをご利用にならないでください。
本サービスは、予定の管理、AI による旅程作成、イベントの共有、友だち・グループでの共同編集、Apple Watch とウィジェットでの通知を提供します。本サービスは継続的に開発中であり、機能の追加・変更・削除が行われることがあります。中断やエラーのない動作は保証しません。
AI の提案と移動時間はあくまで参考です。旅程の提案は入力内容をもとに AI が生成し、移動時間は推計値です。営業時間、チケット、運行時刻、料金、交通状況は出発前にご自身でご確認ください。法令が認める範囲において、これらの情報に依拠したことによる損害について当社は責任を負いません。
利用者が作成した予定、イベント、テキスト、画像その他の内容（以下「利用者コンテンツ」）の権利は利用者に帰属します。本サービスの運営のため、利用者は当社に対し、設定した公開範囲の中で当該コンテンツを保存・表示・送信・バックアップするための、世界的、非独占的、無償かつ再許諾可能なライセンスを付与します。コンテンツまたはアカウントを削除した時点でライセンスは終了します（すでに他の利用者と共有されたもの、および法令により保存が必要なものを除く）。
利用者は、利用者コンテンツについて必要な権利を有し、第三者の権利を侵害せず、法令に違反しないことを表明し保証します。
本サービスの利用にあたり、次の行為を禁止します：
違反があった場合、当社はコンテンツの削除、機能の制限、アカウントの停止を行うことがあります。
本サービスは第三者サービス（Apple でサインイン、Google ログイン、Google マップ、クラウドおよび AI の提供者など）と連携します。これらの利用には各社の規約が適用されます。第三者のコンテンツ、サービス、その提供状況について当社は責任を負いません。
本サービスのソフトウェア、画面デザイン、商標、図版、テーマコンテンツ、ドキュメントは当社または当社のライセンサーに帰属し、法令により保護されています。本規約で明示的に認められる場合を除き、当社の書面による同意なく複製、改変、配布、商業利用することはできません。
本サービスは「現状有姿」「提供可能な範囲」で提供され、商品性、特定目的への適合性、非侵害を含むいかなる明示または黙示の保証も行いません。正確性、完全性、適時性、無中断性も保証しません。
法令が認める最大限の範囲で、本サービスの利用または利用不能から生じる間接的・付随的・結果的・懲罰的損害および逸失利益（不可抗力、第三者サービス、利用者の端末やネットワークに起因するものを含む）について、当社は責任を負いません。当社の責任の総額は、請求前 12 か月間に利用者が本サービスについて当社に支払った金額を上限とし、支払いがない場合は 50 米ドルを上限とします。
当社は本規約をいつでも更新でき、その際は本ページの日付を変更します。重要な変更はアプリ内でもお知らせします。変更後の継続利用は、更新後の規約への同意とみなされます。相当の予告をもって本サービスの全部または一部を停止・終了することがあり、本規約違反があった場合はアカウントを直ちに停止することがあります。
本規約は中華人民共和国法に準拠します（抵触法の規定を除く）。紛争が生じた場合、両当事者はまず誠実に協議し、解決しないときは、いずれの当事者も当社の登記地を管轄する裁判所に訴えを提起できます。本規約は、利用者の居住地の法律により排除できない消費者の権利に影響を与えません。
いずれかの条項が無効とされた場合も、他の条項は引き続き有効です。本規約とプライバシーポリシーが、利用者と当社の間の完全な合意を構成します。各言語版に齟齬がある場合は繁体字中国語版が優先し、他の言語版は便宜のために提供されるものです。

Estos Términos del servicio (los «Términos») constituyen un acuerdo entre tú y Shanghai Huodonli Creative Service Co., Ltd. («nosotros») que regula el uso de la app de Secalender para iOS, la app para Apple Watch, los widgets y el sitio secalender.com (el «Servicio»). Léelos antes de usar el Servicio.
Al descargar, instalar, registrarte o usar el Servicio confirmas que has leído y entendido estos Términos y nuestra Política de privacidad, y que aceptas quedar vinculado por ellos. Si no estás de acuerdo, no uses el Servicio.
El Servicio ofrece gestión de agenda, planificación de viajes con IA, compartición de eventos, colaboración con amigos y grupos, y avisos en Apple Watch y widgets. El Servicio está en desarrollo continuo: pueden añadirse, cambiarse o retirarse funciones, y no garantizamos un funcionamiento ininterrumpido ni libre de errores.
Los planes de IA y los tiempos de desplazamiento son orientativos. Las propuestas de itinerario las genera la IA a partir de lo que introduces, y los tiempos de viaje son estimaciones. Confirma horarios, entradas, frecuencias, precios y tráfico antes de salir. En la medida permitida por la ley, no respondemos de las pérdidas derivadas de confiar en esa información.
Conservas la titularidad de los calendarios, eventos, textos, imágenes y demás contenido que creas (el «Contenido»). Para operar el Servicio nos concedes una licencia mundial, no exclusiva, gratuita y sublicenciable para almacenar, mostrar, transmitir y respaldar ese contenido dentro de la visibilidad que tú definas. La licencia termina cuando eliminas el contenido o tu cuenta, salvo el contenido ya compartido con otras personas o el que debamos conservar por ley.
Declaras que tienes los derechos necesarios sobre tu Contenido y que este no infringe derechos de terceros ni la ley.
Al usar el Servicio no puedes:
Si incumples estas reglas podemos retirar contenido, limitar funciones o cerrar tu cuenta.
El Servicio integra servicios de terceros (por ejemplo, Iniciar sesión con Apple, Google Sign-In, Google Maps y proveedores de nube e IA). Su uso se rige por sus propias condiciones. No respondemos del contenido, los servicios ni la disponibilidad de terceros.
El software, el diseño de la interfaz, las marcas, los gráficos, el contenido temático y la documentación del Servicio nos pertenecen a nosotros o a nuestros licenciantes y están protegidos por la ley. Salvo lo expresamente permitido en estos Términos, no puedes copiarlos, modificarlos, distribuirlos ni usarlos comercialmente sin nuestro consentimiento por escrito.
El Servicio se presta «tal cual» y «según disponibilidad», sin garantías de ningún tipo, expresas o implícitas, incluidas las de comerciabilidad, idoneidad para un fin concreto y no infracción. No garantizamos que el Servicio sea exacto, completo, puntual ni ininterrumpido.
En la medida máxima permitida por la ley, no respondemos de daños indirectos, incidentales, consecuentes o punitivos ni del lucro cesante derivados del uso o la imposibilidad de uso del Servicio, incluidos los causados por fuerza mayor, servicios de terceros o tu dispositivo o red. Nuestra responsabilidad total se limita al importe que nos hayas pagado por el Servicio en los 12 meses anteriores a la reclamación o, si no has pagado nada, a 50 USD.
Podemos actualizar estos Términos en cualquier momento y cambiaremos la fecha de esta página; los cambios sustanciales se anunciarán también en la app. Seguir usando el Servicio tras un cambio implica que aceptas los Términos actualizados. Podemos suspender o interrumpir todo o parte del Servicio con un preaviso razonable, y cerrar tu cuenta de inmediato si incumples estos Términos.
Estos Términos se rigen por la legislación de la República Popular China, excluidas sus normas de conflicto de leyes. Las partes intentarán resolver cualquier controversia mediante negociación de buena fe; de no lograrlo, cualquiera de ellas podrá acudir al tribunal competente de nuestro domicilio social. Nada de lo aquí dispuesto afecta a los derechos de consumidor que no puedan excluirse según la ley de tu lugar de residencia.
Si alguna cláusula se declara inválida, las demás seguirán vigentes. Estos Términos y la Política de privacidad constituyen el acuerdo completo entre tú y nosotros. En caso de discrepancia entre versiones, prevalece la versión en chino tradicional; las demás se ofrecen por comodidad.
